Amazon Brand Registry unlocks the tools that make a brand on Amazon.in hard to copy: removing counterfeit listings, controlling the product detail page, A+ content, a Brand Store and Sponsored Brands ads. It costs nothing to join. The entry ticket is a trademark, and most refused or stalled enrolments fail on a detail of that trademark rather than on anything Amazon does.
What Amazon checks
| Requirement | What it means in practice | Where it goes wrong |
|---|---|---|
| A trademark from IP India | An active registration, or in many cases a pending application. The seven-digit application number on your filing receipt is what Amazon asks for. | A company name, GST registration or Udyam certificate is not a trademark and is not accepted. |
| A mark with text | A word mark, or a logo that contains the brand name in letters or numbers. | An image-only logo (a symbol with no words) is not eligible. |
| Exact name match | The brand name entered in Brand Registry must match the trademark text. Capitalisation can differ; spaces, hyphens and symbols cannot. | "Glow Up" on the packaging, "GlowUp" in the application. |
| Brand on the product | Photos showing the name permanently printed, stitched or engraved on the product or its packaging. | Stickers, labels, stock photos and mockups are refused. |
| Verification | Amazon sends a code to the public contact on the trademark record, who passes it to you. | The contact is the agent who filed, and nobody there answers. |
You do not have to wait for registration
Registration in India takes from six months on a smooth application to two years when there is a hearing (the timeline guide has the stages). Amazon's rules allow enrolment on a pending application in many cases, and Indian sellers routinely enrol as soon as IP India issues the application number, which happens the day Form TM-A is e-filed.
Two things follow. First, the application has to stay alive: an examination objection is a normal stage, but an application that is abandoned for want of a reply, or refused, no longer supports the enrolment. Second, the protection tools are only as strong as the mark behind them, so a name that is likely to be refused as descriptive is a poor base for a marketplace brand. Check that before filing (how to search).
The verification code: the step that stalls most enrolments
When you apply, Amazon does not contact you. It contacts the public contact on the trademark record at IP India, and that is normally the trademark agent or attorney who filed the application, not the brand owner. They receive a code and must forward it to you so you can complete enrolment.
This is where cheap, high-volume filing services cause trouble. The application was filed in your name, but their email is on the record, and the code goes to a general inbox. Before you file, ask who will be the contact on record and how quickly they will forward an Amazon code. If your application is already filed, look it up on IP India's public search: the agent's name and address for service appear in the application details. If that agent cannot be reached, a new agent can be appointed and the record updated, but it takes time, so do it before you start enrolment.
Word mark or logo?
For Brand Registry, file the word mark first. It is the simplest to match exactly, it protects the name in any font or design, and it survives a logo redesign. A logo that contains the name is also accepted, but the enrolment name must match the text in the logo letter for letter, and a stylised spelling can make that awkward. An image-only logo cannot be used for enrolment at all. The trade-offs are set out in logo vs wordmark.
Which class
File in the class of the goods you sell under the brand. Some common marketplace categories:
| You sell | Goods class |
|---|---|
| Clothing, footwear, caps | Class 25 |
| Cosmetics, skincare, soaps, perfumes | Class 3 |
| Supplements and medicinal products | Class 5 |
| Phone accessories, cables, chargers, earphones | Class 9 |
| Jewellery and watches | Class 14 |
| Bags, wallets, leather goods | Class 18 |
| Kitchenware and household utensils | Class 21 |
| Tea, coffee, biscuits, spices, confectionery | Class 30 |
Class 35 covers retail and online-store services. It protects the shop, not the products, so it is an addition for a brand that is also a store, not a substitute for the goods class. If your range spans categories, the free Class Finder lists the classes for a one-line description of the business.
Flipkart and other marketplaces
Flipkart's brand approval for your own brand asks for trademark documents, usually the registration certificate or the application, with the brand logo, product images and packaging details. A seller listing someone else's brand needs an authorisation letter from the brand owner instead, addressed to the marketplace. Approval for a new brand typically takes days to a couple of weeks.
The same trademark serves every marketplace, so the decisions above (word mark, goods class, an exact name, a reachable contact on record) apply whichever platform you start with.
Why enrolments are refused
- The brand name in the enrolment and the trademark text differ by a space, hyphen or symbol.
- The only trademark is an image-only logo.
- The product photos show a sticker or a mockup, not the brand printed on the product or packaging.
- The verification code went to a filing agent who never forwarded it.
- The applicant on the trademark is a different person or entity from the one enrolling, with no authorisation linking them.
- The application behind the enrolment was abandoned after an unanswered objection.
After enrolment: watch the journal
Brand Registry deals with copies on Amazon. It does nothing about a competitor who files a similar trademark at the Registry, which becomes the basis for their own enrolment if it registers. Those applications are published in the weekly Trade Marks Journal, and you have four months from publication to oppose. Brand Watch reads every issue, logos included, and emails you if a similar mark appears. It is free. The opposition procedure is in the opposition guide.
Checklist before you file
- The brand name is spelt exactly as it will appear on the packaging.
- A word mark, in the class of your goods.
- The applicant is the person or company that will enrol in Brand Registry.
- You know who the contact on record will be, and they will forward the verification code.
- Packaging or product with the name printed on it, photographed properly.
- Someone is watching for the examination report, so the application does not lapse.
Frequently asked questions
Do I need a registered trademark for Amazon Brand Registry in India?
Not necessarily registered. Amazon's rules accept an active registration or, in some cases, a pending application, and Indian sellers routinely enrol on the application number IP India issues when Form TM-A is filed. Confirm the current rule in Seller Central when you enrol, because Amazon changes it from time to time.
Can I enrol in Brand Registry with only a logo trademark?
Only if the logo contains words, letters or numbers. Amazon accepts word marks and design marks with text, but not image-only marks. The brand name you enter must also match the text in the trademark exactly.
Who receives the Amazon Brand Registry verification code?
The public contact on the trademark record, which for most applications is the agent or attorney who filed it, not the seller. That person must pass the code to you. If you cannot reach whoever filed your application, enrolment stops at this step.
Which trademark class do I need for Brand Registry?
The class of the goods you sell under the brand: Class 25 for clothing, 3 for cosmetics, 30 for packaged food, 9 for electronics accessories, and so on. Class 35 covers retail services, not the products themselves, so it is not a substitute for the goods class.
What happens to Brand Registry if my trademark application is objected?
An objection is a normal stage and does not end the application, so it does not by itself end your enrolment. What matters is replying in time: an application that is abandoned or refused no longer supports enrolment, and the brand protection tools depend on it.
Does Flipkart need a trademark for brand approval?
For your own brand, Flipkart's brand approval asks for trademark documents (the certificate, or the application in many categories) along with brand and product details. A reseller of someone else's brand needs an authorisation letter from the brand owner instead.
Can I use a sticker with my brand name on the product photos for Brand Registry?
No. Amazon requires the brand name to be permanently affixed to the product or packaging, for example printed or engraved. Stickers, labels, stock images and computer-generated mockups are rejected.
