"How long will it take?" is the second question every applicant asks, after the fee. The honest answer depends on one event: whether the examiner objects. This guide sets out the timeline for the smooth path and the objected path, with the durations we actually see at the Registry in 2026, and shows which parts are in your control.
The smooth path: no objection, no opposition

If the mark is opposed
An opposition adds a contested proceeding after publication: counter-statement, two rounds of evidence, a hearing and an order. Commonly one to three years on top of the time already spent, though many oppositions settle within months. The opposition guide has the full procedure and deadlines.
What slows an application down
- A descriptive or crowded name. The single biggest cause of objections, and therefore of delay. A pre-filing search shows the risk before the fee is paid.
- Formal defects. A missing power of attorney, a user affidavit not filed with a claimed date of use, an unclear goods description. Each triggers a compliance requirement and a wait.
- Missed deadlines. Not delay, but death: an unanswered examination report or opposition ends the application. The abandonment guide covers the narrow way back.
- Hearing backlogs. Vary by Registry office. Delhi and Mumbai carry the largest volumes.
- Logo marks. Vienna coding adds a few weeks compared with a plain wordmark.
What you can do to shorten it
- Choose a distinctive name. Coined words and unexpected combinations clear examination; descriptive ones do not. This is the decision that saves a year.
- File a complete application. Correct applicant category, precise specification, MSME or startup certificate for the lower fee, power of attorney and user affidavit attached where needed.
- Reply to the examination report within days, not at the deadline. The examiner's queue starts when the reply lands.
- Consider expedited examination on Form TM-M if the brand launch depends on it. Government fee ₹20,000 or ₹40,000 depending on applicant type; it moves examination up to a matter of weeks. It cannot shorten the four-month opposition period.
- Watch the file. A report or hearing notice sent to an unmonitored agent email is the commonest way a fast application turns into an abandoned one.

What is the minimum time for trademark registration in India?
Around six to eight months. That requires the application to pass examination without objection, be advertised promptly, receive no opposition in the four-month window, and be processed to registration without delay. It happens, but it is the best case, not the norm.
How long does the examination report take after filing?
In our experience one to three months in 2026, depending on the Registry office and the volume of filings. The status moves from Formalities Chk Pass to Marked for Exam and then to Exam Report Issued.
Can I speed up trademark registration?
Partly. Expedited examination on Form TM-M, for a government fee of ₹20,000 (individual, startup, MSME) or ₹40,000 (others), moves the application to the front of the examination queue, and the Registry aims to examine it within weeks. It does not shorten the four-month opposition period or a hearing queue.
Can I use my brand while registration is pending?
Yes, with the ™ symbol. Use during the application also builds evidence that helps if a distinctiveness objection is raised. The ® symbol waits for the certificate.
Does a trademark objection delay registration?
Yes. Filing the reply takes up to a month; the examiner's decision on it can take several months; and if a hearing is listed, hearing dates are commonly six to twelve months out. An objected application typically registers twelve to twenty-four months after filing.
From which date does trademark protection start?
Once registered, the registration takes effect from the date of application, not the date of the certificate. The ten-year term also runs from the application date. This is why filing early matters even though registration takes time.
Why has my application been at the same status for months?
Usually because it is in a queue: for examination, for a hearing, or for post-opposition processing. If it has been static for over a year with no pending action from you, ask the Registry or an attorney to check; occasionally a file needs a nudge.
