Frequently asked questions

What is Class 35 in trademark registration?

Class 35 is the Nice Classification class for advertising; business management, organisation and administration; office functions; retail and wholesale services; online marketplaces. In India a trademark is registered class by class, so a Class 35 registration protects the mark for those services only.

What is the difference between Class 35 and Class 42?

Class 35 covers advertising, business and retail; Class 42 covers software, IT and design services. Class 42 is the one for the technology platform as a service.

Should I file in Class 35 and Class 9 together?

Often, yes. Class 9 is the one for the app or software behind an online platform. A mark registered in one class does not stop a competitor using it in another, and we advise on the class set before filing so you pay only for the classes you need.

Are online marketplaces and e-commerce platforms in Class 35?

Yes. Online marketplaces and e-commerce platforms are among the typical services filed in Class 35, along with retail stores, supermarkets and showrooms and advertising and digital-marketing agencies.

Which businesses usually register in Class 35?

Typically e-commerce and marketplace start-ups, retail chains and franchise brands, marketing and advertising agencies, consultancies and staffing firms and distributors and trading houses. Each files for the specific services it deals in, often alongside Class 9.
